We Enerlly Inc. doing business as CarbonMinus® (hereinafter referred to as “CarbonMinus®”, “Company”, “we,” “us,” or “our”) are owners the website, available on https://carbonminus.com/ (“Website”). The Website showcases our offerings. We have developed software which is offered as SaaS on a subscription basis for energy and resources conservation and sustainability management, hosted on third-party or customer servers (the “Software”). The Software facilitates energy analytics, resources management, audits, IoT management, loss quantification, ISO50001 preparedness, energy efficiency, and asset management capabilities. For ease of reference, the Website and Software are collectively called the (“Platform”).
CarbonMinus® respects the data privacy rights of individuals and has prepared this Privacy Notice in line with its commitment to privacy and personal data protection. This Privacy Notice (“Privacy Notice”) sets forth how we collect, use and protect the personal data collected on this Platform.

- Account creation: Customers may provide us with their Personal Data when Customers create an account for accessing the Software, including your name, email address, contact number and any other information as necessary.

We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns. The User/Customers undertakes that they shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Data shared with us whether of its own or any third party. In the event the User/Customers is sharing any Personal Data on behalf of a third person, the User represents and warrants that he has the necessary authority to share such Personal Data with the Company, obtained a written consent from such third party and the Company shall not be responsible for verifying the same. The User/Customers understands and acknowledges that such Personal Data shall be subject to the terms and conditions of this Privacy Notice.

The residents of India can exercise the following rights with respect to Personal Data and request information related to processing of Personal Data:
- Right to Access;
- Right to Correction and Erasure;
- Right of Grievance Redressal: residents of India have the right to have readily available means of grievance redressal mechanisms provided by Company for any acts and omissions of Company regarding the handling of individuals’ personal data or the exercise of their rights.
- The residents can also approach Data Protection Board of India (DPBI), in case the Company fails to resolve any privacy-related grievances, disputes and issues of the residents.
- Right to Nominate: residents of India have the right to nominate another individual, who will exercise these rights on their behalf in case of any resident’s death or incapacity.
- Information For EU And UK Visitors
Residents of the European Union (“EU”) and United Kingdom (“UK”) should note that this Privacy Notice has been updated in accordance with the requirements of the EU General Data Protection Regulation (the “GDPR”) and the UK GDPR, the United Kingdom Data Protection Act 2018, the Privacy and Electronic Communications Regulations, and any regulation superseding any of the foregoing (“UK Privacy Laws”). As per the provisions of the GDPR and UK Privacy Laws we shall be considered the Controllers of the Personal Data collected as a result of your use / access of the Website and Processors of the Personal Data collected as a result of your use / access of the Software.

We may send Users/Customers communications including but not limited to (a) notices about Users/Customers’ use of our Platform, including those concerning violations of use, (b) updates, (c) promotional information regarding our offerings, and (d) newsletters. Users/Customers may opt out of receiving promotional emails and newsletters from us by following the unsubscribe instructions provided in those emails. Alternatively, users/Customers can opt out, at any time, by emailing privacy@carbonminus.com with your specific request.

We will retain User’s Personal Data as long as it is required to be retained for the purpose of provision of the services on our Platform. We may also retain and use Users/Customers Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

These links are not an endorsement of, or representation that we are affiliated with, any third party. We are committed to maintaining information security and protecting customer data from potential breaches. Although we provide appropriate firewalls and protection, we cannot warrant the security of Personal Data transmitted as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we will take necessary measures to mitigate such events.

Our Platform is not intended for children, and we do not knowingly collect Personal Data from children. We define “children” as anyone under 16 years old.
